Acceptable Use Policy

1. INTRODUCTION

This Acceptable Use Policy (the "AUP") sets out the rules governing your use of Pulp (the "Service"), operated by Offline Studio, a French société par actions simplifiée unipersonnelle (SASU), registered under SIREN 106879430, with its registered office at 61 rue de Lyon, 75012 Paris, France.

This AUP supplements our Terms and Conditions (available at https://pulp-app.io/terms), our Community Guidelines (available at https://pulp-app.io/community-guidelines), and our Privacy Policy (available at https://pulp-app.io/privacy). By accessing or using the Service, you agree to comply with this AUP.

Violation of this AUP may result in warnings, restrictions, suspension, or permanent termination of your account, in accordance with Section 7 of our Terms and Conditions.

2. ELIGIBILITY AND AGE VERIFICATION

The Service is strictly reserved for individuals who are at least eighteen (18) years of age, or the age of majority in their country of residence if that age is higher. Any user who does not meet this age requirement is prohibited from accessing or using the Service.

Users represent and warrant that they meet this age requirement upon registration and throughout their use of the Service. Any false declaration regarding age constitutes a material breach of this AUP and shall result in immediate termination of the account, without prejudice to any other remedy available to Offline Studio under applicable law.

Offline Studio may implement additional age verification measures at any time, including but not limited to document verification, biometric verification, or third party verification services. Users agree to cooperate with any such verification process as a condition of continued access to the Service.

3. PROHIBITED CONDUCT

You expressly agree not to engage in any of the following conduct on or in connection with the Service:

  • (a) using the Service if you do not meet the eligibility requirements set out in Section 2;
  • (b) knowingly interacting with a user whom you know or reasonably believe to be a minor, including for any purpose involving child sexual exploitation or abuse (CSEA) or child sexual abuse material (CSAM);
  • (c) using the Service to stalk, harass, intimidate, threaten, defame, extort, defraud, impersonate, discriminate against, commit sexual violence against, or otherwise cause harm to any user or any third party;
  • (d) engaging in hate speech, discrimination, incitement to violence, transphobia, misogyny, racism, xenophobia, or any conduct targeting a person or group based on their identity, including but not limited to race, ethnicity, national origin, religion, sexual orientation, gender identity, gender expression, disability, or physical appearance;
  • (e) collecting, storing, disclosing, or otherwise processing personal information about other users without their prior informed consent, including but not limited to their location, identity, contact details, or images;
  • (f) using the Service for any commercial purpose, including but not limited to advertising, promotion, solicitation, recruitment, fundraising, sale of goods or services, or transmission of unsolicited commercial communications, without prior written authorization from Offline Studio;
  • (g) using the Service, or any content, data, output, or information derived from the Service, to train, develop, test, or otherwise improve any artificial intelligence system, machine learning model, or automated system;
  • (h) impersonating any person, entity, or user, misrepresenting your affiliation with any person or entity, or using false or misleading information in your profile or communications;
  • (i) violating any applicable law, regulation, or third party right, including but not limited to intellectual property rights, privacy rights, image rights, and consumer protection laws, including laws prohibiting child sexual exploitation or abuse (CSEA), child sexual abuse material (CSAM), sexual violence, and sex trafficking;
  • (j) interfering with, disrupting, or damaging the operation of the Service, including but not limited to introducing viruses, malware, or malicious code, conducting denial of service attacks, or attempting to gain unauthorized access to the Service, other users' accounts, or Offline Studio's systems;
  • (k) reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or underlying structure of the Service;
  • (l) scraping, crawling, indexing, or otherwise extracting data from the Service through automated means, including but not limited to bots, spiders, or scrapers;
  • (m) creating, using, or maintaining multiple accounts, or circumventing any suspension or termination of your account;
  • (n) selling, transferring, or authorizing access to your account by any third party.

4. PROHIBITED CONTENT

You expressly agree not to publish, transmit, share, or otherwise make available on the Service any content that:

  • (a) involves, depicts, or references any individual under the age of eighteen (18), regardless of context, framing, or intent, including any child sexual exploitation or abuse (CSEA) or child sexual abuse material (CSAM);
  • (b) is non consensual, including but not limited to non consensual intimate imagery, images or recordings obtained without consent, and any content shared without the informed consent of the persons depicted;
  • (c) consists of, incorporates, or is generated using deepfake technology, synthetic media, or artificial intelligence in a manner that misrepresents the identity, actions, or statements of a real person;
  • (d) is unlawful under applicable law, including but not limited to content facilitating criminal activity, terrorism, human trafficking, sex trafficking, sexual violence, exploitation, or the illegal sale of goods or services (including but not limited to weapons, controlled substances, or counterfeit items);
  • (e) constitutes hate speech, incitement to violence, discrimination, or targeted harassment based on identity;
  • (f) infringes any intellectual property right, privacy right, image right, or other proprietary right of any third party;
  • (g) promotes, facilitates, or advertises escort services, sex work, prostitution, or the exchange of sexual services for money or other consideration;
  • (h) promotes, facilitates, or advertises self harm, suicide, eating disorders, or other conduct that may cause physical or psychological harm to users or third parties;
  • (i) constitutes spam, phishing, fraud, or any other form of deceptive or malicious communication.

5. CONTENT STANDARDS FOR PUBLIC PROFILES

In your public profile, including profile pictures, biography, and any other content visible to other users prior to a direct interaction, you agree not to include content depicting:

  • (a) explicit nudity, visible genitalia, sexual acts, or content of a pornographic nature;
  • (b) drugs, drug paraphernalia, or the promotion of illegal substances;
  • (c) weapons, violence, or graphic imagery;
  • (d) commercial promotions, advertisements, or solicitations for goods or services.

6. CONTENT STANDARDS FOR PRIVATE COMMUNICATIONS

In private communications between users, sexually explicit content and sexually driven behavior are prohibited, including between consenting adult users.

  • (a) all users involved must comply with this prohibition and may not use private communications for sexually explicit or sexually driven interactions;
  • (b) the transmission of explicit content, including intimate images or explicit messages, is strictly prohibited;
  • (c) all content shared in private communications remains subject to Section 4 (Prohibited Content) and applicable law;
  • (d) private communications may not be used to organize, promote, or facilitate any activity prohibited by this AUP or applicable law, including but not limited to escort services, sex work, or the sale of illegal goods or services.

7. PROHIBITED USE OF PAYMENT FEATURES

Where the Service enables payments or subscriptions, you expressly agree not to use such payment features for:

  • (a) any transaction related to escort services, sex work, prostitution, or the exchange of sexual services for money or other consideration;
  • (b) any transaction related to the sale of illegal goods or services;
  • (c) any transaction intended to launder funds, evade taxes, or otherwise violate financial regulations;
  • (d) any fraudulent transaction, including but not limited to unauthorized use of payment methods, use of stolen payment credentials, or misrepresentation of the nature of the transaction;
  • (e) any transaction between users organized through the Service outside of the official payment channels provided by Offline Studio.

Offline Studio uses third party payment processors, including Stripe, whose own terms and acceptable use policies apply in addition to this AUP.

8. REFUND AND CHARGEBACK POLICY

Refund conditions applicable to paid access to the Service are set out in our Terms and Conditions (Section 9), which include the mandatory right of withdrawal for EU consumers within fourteen (14) days from the date of purchase, in accordance with Directive 2011/83/EU on Consumer Rights.

Users are encouraged to contact Offline Studio at the contact details set out in Section 13 prior to initiating a chargeback with their payment provider, in order to resolve any dispute directly.

The submission of a chargeback in bad faith, including but not limited to disputing a legitimate transaction, disputing a transaction for which the Service was provided as agreed, or disputing a transaction after having benefited from the Service, constitutes a breach of this AUP and may result in termination of the account and reporting to the relevant payment processor.

9. ZERO TOLERANCE

Offline Studio operates a zero tolerance policy in respect of the following conduct or content:

  • (a) child sexual exploitation or abuse (CSEA) and child sexual abuse material (CSAM);
  • (b) non consensual content, including non consensual intimate imagery;
  • (c) hate speech, incitement to violence, or threats of physical harm;
  • (d) content or conduct that facilitates human trafficking, sex trafficking, exploitation, sexual violence, or other serious criminal activity;
  • (e) content that promotes or facilitates escort services or sex work.

Any breach of this Section 9 shall result in immediate and permanent termination of the user's account, without prior notice, and may be reported to competent authorities in accordance with applicable law.

10. REPORTING VIOLATIONS

Users are encouraged to report any suspected breach of this AUP through the in service reporting tools or by email to the contact details set out in Section 13.

When submitting a report, users are encouraged to provide sufficient information to enable Offline Studio to review the report, including the identity of the user or content concerned, the nature of the alleged breach, and any relevant context.

Reports concerning immediate safety risks, illegal content, or breaches of Section 9 (Zero Tolerance) shall be reviewed as a priority.

11. ENFORCEMENT

Offline Studio reserves the right, but has no general obligation, to monitor, review, moderate, filter, restrict, edit, remove, or refuse to display any content on the Service, at its sole discretion and without prior notice, where Offline Studio considers in good faith that such content breaches this AUP, our Terms and Conditions, our Community Guidelines, applicable law, or third party rights.

Following review, Offline Studio may take any enforcement action it considers appropriate, including but not limited to:

  • (a) removing, hiding, or modifying the content concerned;
  • (b) issuing a warning to the user concerned;
  • (c) restricting certain features or functionalities of the user's account;
  • (d) suspending the user's account for a temporary period;
  • (e) permanently terminating the user's account;
  • (f) blocking access from certain IP addresses or devices;
  • (g) reporting the matter to competent authorities where required by law or where Offline Studio believes such reporting is appropriate.

Where Offline Studio becomes aware of content that Offline Studio has reason to believe constitutes illegal content under applicable law, Offline Studio shall take appropriate action, including removal of the content and, where required by law or appropriate in the circumstances, notification of competent authorities.

12. RIGHT TO CONTEST

A user who is subject to an enforcement action may contest such action by contacting Offline Studio at the contact details set out in Section 13 within thirty (30) days of the enforcement action. Offline Studio will use reasonable efforts to review the contestation and provide a response within a reasonable time.

14. UPDATES TO THIS AUP

Offline Studio may update this AUP at any time to reflect changes in the Service, applicable law, or best practices. Material updates will be notified to users through the Service or by email at least fifteen (15) days before entry into force.
